Statement of non-production
LewdChat ("the Site", "we") is a text-based chat platform that supports user-initiated image uploads. We do not produce, create, generate, commission, edit, or select any visual depictions of sexually explicit conduct as defined in 18 U.S.C. § 2257 and 28 C.F.R. Part 75. We do not contract models, direct performances, or curate uploads. We do not manage the visual content users choose to share.
Accordingly, LewdChat is not a "producer" as that term is defined in 18 U.S.C. § 2257(h)(2)(A) and 28 C.F.R. § 75.1(c), and the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 do not apply to us. The exemption at 28 C.F.R. § 75.1(c)(4)(v) applies — we provide a platform for communication but do not manage or editorially control the visual content transmitted on it.
User-generated content
Any visual material that appears in a chat room is uploaded, linked, or transmitted by individual users acting on their own. We exercise no editorial control before upload. Per 47 U.S.C. § 230(c)(1), we are not the publisher or speaker of user-uploaded content. For any such content, the original producer (i.e., the person who created it) is responsible for compliance with 18 U.S.C. § 2257 and all other applicable law. If content that shouldn't be on the Site is shared, see our takedown procedure or contact compliance@lewdchat.com.
Age verification
The Site and chat service are restricted to users 18 years or older. Access is gated by an age-verification prompt. Users represent and warrant, upon each visit, that they are of legal age. We have no means of independently verifying user age and rely on this self-attestation as well as the Restricted to Adults (RTA) website label (RTA-5042-1996-1400-1577-RTA) which is recognized by adult-content filtering software.
Moderation
We actively moderate chat rooms and remove content, users, and connections that appear to violate applicable law — in particular any depiction or discussion involving persons under 18. We cooperate with law enforcement and the National Center for Missing & Exploited Children (NCMEC) as required.
